  • Introduction

Renovate Mzansi and its subsidiaries (“Renovate Mzansi”, “we” or “us”) respect your privacy and are committed to protecting your personal data. This Privacy Policy lets you know how we collect, use, share and protect your personal data, and also briefly talks about your privacy rights and how the law protects you. By using our Services or by otherwise sharing with us your personal data, you agree to the terms of this Privacy Policy. Please review it carefully to understand our privacy practices.   • Data Subjects

Renovate Mzansi has several categories of data subjects whose data will be processed and controlled, due to regulatory, operational and / or other needs. We have highlighted the main ones below. Since personal data is collected by Renovate Mzansi from the following categories of people, they are deemed to be Data Subjects, and Renovate Mzansi the Data Controller.

  • Employees

This refers to any individuals directly or indirectly employed by Renovate Mzansi. Renovate Mzansi may control and process data relating to their employees to allow for identification, validation as well as processing of regulatory information such as remittances on taxes and other key data required by the Government of South Africa. Such data may also be shared with authorised third parties where necessary for fulfilment of a contractual obligation or based on consent. The data we process in respect of employees may also include sensitive personal or health data for e.g. biometric access control, and where applicable, for the provision of medical insurance / healthcare to the Employees. Where this is the case, Renovate Mzansi will always seek the consent of the Data Subject, and we will always explain to the Data Subject why this data will be processed. However, we are aware that this may not always be possible, for example, if there would be any emergencies or life-threatening instances in which consent is not obtainable.

  • Clients

This refers to all our valued Clients, who may procure any goods or services from us or from any other third-party partners with whom we collaborate to provide these goods or services. Renovate Mzansi may share your personal data with authorised third parties so that we may fulfil your orders / requests, e.g. when you have placed an order with us, or require certain product / service delivery to the address that you have given us. Renovate Mzansi may also control and process personal data related to our Clients in furtherance of a contractual obligation we have with you, due to any legal obligations or due to other operational processes.

  • Renovate Mzansi Partners

This category includes all Renovate Mzansi partners who have a business relationship, collaborative initiative, and existing connection with us, either directly or indirectly, that may involve the processing of personal data. This processing might be due to regulatory compliance, internal processes and / or other assessed needs in line with this policy, and accordingly, may be shared with authorised third parties.

  • Rights of Renovate Mzansi data subjects

Renovate Mzansi is committed to the promotion and enforcement of the rights of you, our Data Subjects. These include, but are not limited to, the right:

  • To be informed of the use to which your personal data is to be put;
  • To allow you to access your personal data in the custody of Renovate Mzansi, as a data controller or data processor;
  • To object to the processing of all or part of your personal data;
  • To correction of false or misleading data; and
  • To the deletion of any false or misleading data about you.
  • Data subject consent

Renovate Mzansi shall ensure that you, as the data subject, are made aware that we will collect, store, share, and use your personal data. We shall further strive to ensure that you, as the data subject, where applicable, approves such collection, preservation, and use of your personal data. While acquiring your consent, we shall ensure that the Data Subject is aware of their rights and shall further provide the means for the exercise of such rights, where applicable.

  • Withdrawal & revision of consent

As our Data subjects, you can, subject to the applicable laws, withdraw or revise the terms of use of your personal data held by Renovate Mzansi. If any such request is made to us, we will do all we can to respond to you within 72 hours of receipt of this request. If you have any reason to believe that the data we have is inaccurate, outdated, or incomplete, please feel free to present a revision/correction request to us for our further action. Renovate Mzansi shall cease processing of data in the below situations:

  • Where the accuracy of the personal data is contested by the data subject, and while we verify the accuracy of the data, depending, of course, on the nature and type of personal data referred to.
  • Where personal data is no longer required for the purpose of the processing, unless we may require it for the establishment or defense of a legal claim.
  • Where a Data Subject has objected to the processing, pending verification as to whether the legitimate interests of Renovate Mzansi may override those of the data subject.

To ensure your requests are honoured across the board, where we have shared personal data with a third party for processing purposes, we will take all reasonable steps to inform these third parties that the data subject has withdrawn their right to process such data or that revision of such data has been requested, as the case might be. All withdrawal notices received by us in respect of data held by third parties shall lead to us initiating said third parties to surrender or delete the information held by them. Renovate Mzansi shall make all reasonable effort to ensure that this surrender of your data is satisfactory and that all record of such data has been satisfactorily deleted or expunged from third party systems wherever it may be stored, and in whatever format it may be in..

  • Data Collection

Renovate Mzansi shall employ various options in the collection of personal information. We will ensure that such processing of personal data shall be lawful, specific, and explicitly defined. Information may be voluntarily and directly collected from our data subjects, for example, during the onboarding of a client / employee / supplier, or perhaps indirectly, where:

  • The data is contained in a public record, or the data subject has made the data public.
  • The data subject has consented to the collection from another source.
  • The collection from another source would not prejudice the interests of the data subject.
  • Where collection of data from another source is necessary for:
  • The prevention, detection, investigation, prosecution, and punishment of crime.
  • The enforcement of a law which imposes a penalty, or
  • The protection of the interests of the data subject or another person

Before collection of personal information and data, we shall make our best efforts, as far as is practicable, to ensure that the data subject is reasonably informed of:

  • The use to which their personal data shall be put, their right to access their data, the right to object to processing of all or part of their data and the right to correction and deletion of false or misleading data.
  • The fact that personal data is being collected.
  • The purpose for which the personal data is being collected
  • Access & Transfer of Personal Data

Renovate Mzansi data subjects have a right of access and transfer of all personal data that is held by Renovate Mzansi. Requests for such access should be made to Renovate Mzansi in writing, to Renovate Mzansi Shepstone Street, 17 Queenstown, South Africa. Within 36 hours of us receiving your request, a Renovate Mzansi officer shall communicate in writing or through other official medium of our intention to comply (or whichever decision is taken) with your request and if it is the former, we will also inform you of the expected timeline within which the requested data shall be available for your collection, viewing and transmission. Where a request is received to transfer such data to an external data controller or data processor, we shall take all necessary steps and make reasonable efforts to facilitate this transfer. Where a direct transfer of such data is requested, Renovate Mzansi shall assess the impact and implication of such direct transfer and will only proceed in instances where any associated risks have been assessed to be at a minimum, in order to safeguard your interests. By default, in said instances, we shall submit the requested data to the Data Subject for their onward submission to the external party.

  • Data deletion

Within 36 hours of us receiving your request, a Renovate Mzansi officer shall communicate in writing or through other official medium of our intention to comply (or whichever decision is taken) with your request and if it is the former, we will also inform you of the expected timeline Where the data controller has shared such personal data with a third party for processing purposes, the data controller or data processor shall take all reasonable steps to inform third parties processing such data, that the data subject has requested such erase. In all instances where legal or regulatory requirements prevent us from deleting the data as requested, Renovate Mzansi shall ensure that all Data processing (other than that legally mandated) ceases on such data immediately and that the Data Subject is informed, within a reasonable time, that such deletion cannot occur but that all processing has ceased, or as the case may be.

  • Data Storage and Associated Treatment

Storage of all Renovate Mzansi-controlled personal data shall be under Renovate Mzansi-owned infrastructure and / or infrastructure under contractual Renovate Mzansi ownership.
